The session features speakers representing stakeholders from every facet of dispute resolution: The Chief Transformation & Innovation Officer of the Supreme Court of Singapore, the Singapore International Mediation Centre, an expert witness and private practice litigators.
They will explore the pros and cons of virtual dispute resolution in Asia, and share insights from their practice on what these innovative changes mean for the future of our profession.
Nadia Smahi’s practice focuses on counsel work in international and domestic arbitration, as well as cross-border and domestic litigation. She represents parties and acts as secretary to arbitral tribunals in numerous arbitral proceedings, both ad hoc and institutional (e.g. ICC, LCIA, SCAI, CAS) in various disputes relating to oil and gas, international sales, distribution and licensing agreements, shareholders’ agreements, brokerage contracts, intellectual property disputes and sport related disputes.
She also represents and advises clients in civil litigation proceedings, including in relation to the challenge, recognition and enforcement of arbitral awards and court decisions in Switzerland, but also in relation to various corporate and contractual matters under Swiss law.
In addition, she has concrete experience in representing and advising clients in intellectual property matters, in particular trademarks, patents, copyrights, designs and unfair competition law disputes.
Nadia Smahi regularly speaks and writes on International Arbitration and Intellectual Property topics. She has been elected LCIA YIAG Regional Representative for Europe and has co-organised numerous International Arbitration events for young practitioners across Europe.
Marjolein has been working with BarentsKrans as a lawyer since April 2012. Her work focuses on preventing and settling national and international disputes within and between companies and/or joint ventures (Corporate and Commercial Litigation). This covers disputes within companies (internal struggles between shareholders/directors) as well as directors’ and officers’ liability, takeover disputes and trade disputes. Marjolein is a litigation expert: she has extensive experience conducting proceedings before the Netherlands Enterprise Chamber and in provisional relief proceedings. Her approach is characterised by consistently setting out a clear and pragmatic (procedural) strategy in consultation with her clients.
Dr. Sinenian has expertise in the fields of applied physics, electrical engineering & computer science and nuclear engineering. He has advised corporate leadership and management on business and technical matters in the automotive, consumer electronics, defense, and medical device industries in the United States, Asia and Australia. Dr. Sinenian has also served as an advisory technical expert to assist clients engaged in disputes in the United States and around the world. He has experience advising clients in matters pertaining to intellectual property, trade secrets, product liability, US ITC investigations, and global disputes (international arbitration), including certain technical aspects of large capital projects involving energy, mining, and transportation.
Dr. Sinenian has experience in the analysis and design of circuits and systems for a wide range of applications, including control systems and instrumentation, power converters, and radio-frequency systems. He has conducted investigations and design reviews of electronic systems to assist clients during product development, to conduct failure analysis, and in various litigation contexts.
Dr. Sinenian also has extensive experience in machine learning, data analytics and algorithm development and analysis. He has experience applying clustering, regression and deep-learning techniques to large datasets to draw actionable insights and for predictive modelling applications. He has analysed dynamic control algorithms in embedded systems and products in the context of failure analysis and assisted clients with software and signal processing related matters in trade secret and intellectual property litigation. He is proficient in numerous languages, including C, C++, Java and Python. Dr. Sinenian is actively involved open-source software development and is the co-author of a book on data structures and algorithms.
Dr. Sinenian has research experience in the area of plasma physics and its applications in propulsion and fusion. In his earlier studies, he designed and built a novel compact radio-frequency driven plasma thruster for small satellite applications. As part of this work, he built plasma diagnostics and used them to characterize the performance of the thruster with argon and nitrogen propellants. In his doctoral research, Dr. Sinenian built nuclear instrumentation and used it to study aspects of laser inertial fusion in support of the national laser fusion program. As part of this work, he led a team that built an ion accelerator laboratory and used it to develop and calibrate nuclear instruments for use on the OMEGA and the National Ignition Facility laser systems. Dr. Sinenian’s dissertation focused on using measurements of fast ions produced in inertial fusion experiments to diagnose the performance of fusion implosions.
Julie Raneda, FCIArb is Partner in our International Arbitration Group in Singapore. She is specialised in international commercial and investment arbitration and has acted as counsel before international arbitral tribunals in a broad range of disputes and under many different laws.
Tan Ken Hwee, currently the Chief Transformation and Innovation Officer for the Singapore Judiciary, first joined the Attorney-General’s Chambers (AGC) in 1995 as State Counsel and Deputy Public Prosecutor. He eventually took on additional roles, as Director of the IT Department, and then Chief Information Officer. He was also a Senior Assistant Registrar of the Supreme Court from 2006-2010.
Ken Hwee was appointed Deputy Chief Prosecutor, and then Chief Prosecutor of the Financial and Technology Crime Division. FTCD handles white-collar and technology-related crimes in Singapore, ranging from financial and securities fraud to corruption, cybercrime and terrorism financing. He currently oversees the transformation, digitalisation, innovation and technology plans of the Supreme Court, the State Courts and the Family Justice Courts and has been involved in legal technology and Tech-law matters in Singapore for 25 years.
We Meng Chuan is an experienced General Counsel of almost 30 years working in Beijing, Hong Kong and Singapore. He has advised senior leadership of MNCs as lead counsel on legal and regulatory issues arising our of doing business in China, Hong Kong, Taiwan, India, Japan, Korea, ASEAN, Australia and New Zealand.
As an active board member of US-China JVs, he has managed a wide range of emerging market risks with international best practices. He believes that the high risk/high potential Asia Pacific markets require a robust management practice that balances creativity with integrity to ensure sustainable business growth.
Leveraging his deep regional experience, he is currently leading SIMC to promote mediation to resolve complex, commercial cross-border disputes in Asia Pacific.
